الشروط والأحكام التي تحكم استخدامك لمنصة ابني صرحك وخدماتها.
The terms and conditions that govern your use of the Ibni Sarhak platform and its services.
تعريفات
Definitions
«المنصة» تعني موقع وتطبيق ابني صرحك. «المستخدم» هو كل من يتصفح المنصة أو يستخدم خدماتها. «المورّد» هو المصنع أو التاجر الذي يعرض المواد. «الطلب» هو طلب شراء مواد عبر المنصة.
“Platform” means the Ibni Sarhak website and app. “User” is anyone who browses the platform or uses its services. “Supplier” is the factory or trader offering materials. “Order” is a purchase request placed through the platform.
الحساب والتسجيل
Account and registration
قد يتطلب استخدام بعض الخدمات إنشاء حساب. أنت مسؤول عن صحة بياناتك وعن سرية بيانات الدخول، وعن كل نشاط يتم عبر حسابك، وعليك إبلاغنا فورًا عند أي استخدام غير مصرّح به.
Using some services may require an account. You are responsible for the accuracy of your data, the confidentiality of your login, and all activity under your account, and must notify us immediately of any unauthorised use.
الطلبات والأسعار وعروض الأسعار
Orders, prices and quotations
الأسعار المعروضة إرشادية للكميات التجارية وقد تتغير حسب السوق. يُثبَّت السعر عند تأكيد الطلب ويبقى عرض السعر ساريًا للمدة الموضّحة فيه. نبذل جهدنا لعرض بيانات دقيقة، وقد نصحّح أي خطأ ظاهر قبل التنفيذ.
Displayed prices are indicative for commercial quantities and may change with the market. The price locks on order confirmation and a quotation stays valid for the period stated on it. We aim to show accurate information and may correct any obvious error before fulfilment.
الدفع
Payment
يتم الدفع عبر الوسائل المتاحة (تحويل بنكي، شبكة، أو حساب آجل للمنشآت المؤهلة). تبقى البضاعة والالتزامات المالية خاضعة للشروط المتفق عليها في عرض السعر والفاتورة.
Payment is made through the available methods (bank transfer, card, or a credit account for eligible companies). Goods and financial obligations remain subject to the terms agreed in the quotation and invoice.
التوصيل والاستلام
Delivery and receipt
نلتزم بمواعيد التوصيل المتفق عليها من لحظة تأكيد الطلب. تُرفق مع كل شحنة المستندات اللازمة كسند التسليم والفاتورة وشهادة المطابقة. على المستلم فحص البضاعة عند الاستلام وإثبات أي تحفّظ في سند الاستلام.
We commit to the delivery windows agreed from order confirmation. Each shipment is accompanied by the necessary documents such as the delivery note, invoice and conformity certificate. The recipient must inspect the goods on receipt and record any reservation on the goods-receipt note.
الإرجاع والاستبدال
Returns and replacement
إذا وصلت البضاعة غير مطابقة أو ناقصة، يحق لك رفضها عند الموقع وإثبات ذلك بتذكرة الوزن، ونستبدلها وفق الشروط المتفق عليها. لا تُقبل مرتجعات المواد المطابقة بعد الاستلام إلا وفق سياسة الإرجاع المعلنة.
If goods arrive non-conforming or short, you may refuse them on site and evidence this with the weighbridge ticket, and we will replace them per the agreed terms. Returns of conforming materials after receipt are accepted only under the published returns policy.
منتجات الموردين وإخلاء المسؤولية
Supplier products and disclaimer
تُعرض المواد من موردين ومصانع خارجيين، وتقع مسؤولية مواصفات المنتج وضماناته على المورّد المنتج، ويوضّح عرض السعر تفاصيل الضمان والإجراء المتبع للأصناف المعيبة. تُقدَّم المنصة «كما هي» دون ضمانات ضمنية تتجاوز ما ينص عليه النظام.
Materials are offered by third-party suppliers and factories, and responsibility for product specifications and warranties lies with the producing supplier; the quotation sets out warranty details and the procedure for defective items. The platform is provided “as is” without implied warranties beyond what the law requires.
الملكية الفكرية
Intellectual property
جميع حقوق المحتوى والعلامات والتصاميم في المنصة مملوكة لـ«ابني صرحك» أو لأصحابها، ولا يجوز استخدامها دون إذن.
All rights in the content, marks and designs of the platform are owned by Ibni Sarhak or their proprietors, and may not be used without permission.
تعديل الخدمة والشروط
Changes to the service and terms
قد نعدّل أو نوقف الخدمة أو أي جزء منها، وقد نحدّث هذه الشروط من وقت لآخر، والنسخة المنشورة هنا تلغي ما قبلها. استمرارك في استخدام المنصة بعد التعديل يُعدّ موافقة عليه.
We may modify or discontinue the service or any part of it, and may update these terms from time to time; the version published here supersedes earlier ones. Your continued use of the platform after a change constitutes acceptance of it.
القانون الواجب التطبيق والاختصاص
Governing law and jurisdiction
تخضع هذه الشروط لأنظمة المملكة العربية السعودية، وتختص الجهات القضائية المختصة في المملكة بالنظر في أي نزاع ينشأ عنها.
These terms are governed by the laws of Saudi Arabia, and the competent Saudi judicial authorities have jurisdiction over any dispute arising from them.
